Terms of Use

Siltwork is an internal stormwater inspection and reporting tool. It helps Grove Point capture field data, complete ADEM-aligned certifications, generate branded PDFs, and manage corrective actions. It is invite-only. There is no public sign-up and no contractor portal in the current product.

The Software, including its design, code, documentation, and branding assets owned by BGF, remains the property of BGF Development, LLC. Grove Point and its authorized users receive a limited, non-exclusive, non-transferable right to use Siltwork for internal compliance operations, subject to any separate agreement with BGF and these Terms.

You may not copy, modify, reverse engineer (except to the extent prohibited by law), redistribute, or create derivative works of the Software without BGF’s prior written consent.

• Accounts are provisioned by Grove Point admins.
• You must use your authorized work identity and keep credentials confidential.
• Roles (admin, inspector, viewer) limit what you can see and change; attempting to bypass those controls is prohibited.
• Grove Point or BGF may suspend access for security, misuse, or end of authorization.

You agree not to:

• Use Siltwork for unlawful purposes or outside authorized work.
• Upload content you lack rights to use, or that is malicious or unrelated to legitimate inspections.
• Interfere with the service, other users, or security controls.
• Share signing links or account access with unauthorized parties.
• Misrepresent certifications, credentials, or inspection findings.

Generated reports are designed to be immutable once issued. You acknowledge that snapshots, signatures, and related artifacts may be retained as compliance records and may be produced in regulatory or legal proceedings. Accuracy of entered data remains the responsibility of the users and Grove Point.

Siltwork is a tool to support compliance; it does not replace professional judgment, permit obligations, or advice of qualified counsel or engineers.

The service depends on infrastructure providers (hosting, database, auth, storage, email, weather data sources). Availability and performance may be affected by those providers. External signing pages and email links are part of the intended workflow.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SILTWORK IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BGF DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT REPORTS WILL SATISFY EVERY REGULATORY REVIEW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BGF DEVELOPMENT, LLC AND ITS LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING FROM USE OF SILTWORK. AGGREGATE LIABILITY ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE FEES PAID TO BGF FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR ONE HUNDRED U.S. DOLLARS IF NO FEES WERE PAID), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

You agree to defend and indemnify BGF against claims arising from your misuse of the Software, your content, or your violation of these Terms, except to the extent caused by BGF’s willful misconduct.

These Terms are governed by the laws of the State of Alabama, excluding conflict-of-law rules, unless a separate written agreement between BGF and Grove Point provides otherwise. Venue for disputes shall lie in the state or federal courts located in Alabama, except where prohibited.

BGF may update these Terms. The Effective date above will be revised when material changes are posted. Continued use after changes take effect constitutes acceptance where permitted by law.
